Brian Abergel is a partner with the firm and is a civil litigator with experience in Commercial Litigation, Real Estate Litigation and Construction Litigation. Prior to joining TPA Law, Mr. Abergel gained invaluable experience at several large law firms in both Miami and Fort Lauderdale. Furthermore, Mr. Abergel was a partner for a boutique law firm for over three years in Miami before coming back to his hometown in Brevard County. Mr. Abergel has litigated many matters before the United States District Court for the Southern District of Florida as well as tried numerous cases at the state court level. Furthermore, Mr. Abergel has worked as in-house counsel for a world leader in digital printing and finishing equipment as it transitioned into a publicly-traded company listed on the NYSE Alternext Paris.

Founded and managed firm consisting of six attorneys and five support staff that specialized in commercial litigation and real estate law, both litigation and transactional matters. Managed case load of over 100 clients; Litigated and won several real estate disputes and commercial matters in state court, including but not limited to a large real estate matters involving foreign investors, title issues, landlord tenant disputes, partnership disputes.

Represent the world’s largest and most successful cruise lines, shipping companies, and their P&I Clubs and insurers. Regularly handled matters involving claims for Jones Act negligence, unseaworthiness, maintenance & cure, unearned wages, retaliatory discharge, COGSA, and Limitation of Liability actions. Drafted all motions, pleadings and evaluation letters for clients. Prepared all documents, case theories, evidence and outlines for litigation process through trial/mediation. Received directed verdict for client in federally litigated maritime trial held in South District of Florida.

Practice concentrated on liability defense including premises, professional negligence, construction litigation, commercial litigation and insurance defense. Drafted all motions, pleadings and evaluation letters for clients. Prepared all documents, case theories, evidence, witnesses and outlines for litigation process through trial/mediation. Day to day responsibilities included drafting responses, taking depositions, site inspections, and attending all hearings. Started as the sole associate of this branch and helped develop south Florida office into five-attorney office and 15 person support staff in less than one year.
